Terms of Service

These Terms of Service (“Terms”) govern your use of poshypeach.com (the “Site”) and your relationship with TampaOF LLC, doing business as Poshy Peach (“Poshy Peach,” “we,” “us,” or “our”). By using the Site or submitting an application, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who can use our Site and services

The Site and our services are intended only for adults aged 18 or older who can form a legally binding contract. By using the Site or applying, you represent that you are at least 18 years old and that the information you provide is true and accurate.

2. What we do

Poshy Peach is an OnlyFans and Fansly management agency. We provide services such as account management, subscriber chatting, sales and pay-per-view strategy, content scheduling, retention, and organic social media growth. The Site describes our services in general terms. The specific services, commission, and other commercial terms for any creator we work with are set out in a separate written management agreement, which controls if anything in these Terms conflicts with it.

3. Applications

Submitting an application does not create a contract or guarantee that we will work with you. We review applications individually and only take on creators we believe we can genuinely help. We may accept or decline any application at our discretion.

4. No income or results guarantee

We do not promise or guarantee any specific income, earnings, growth, or results. Results vary based on many factors, including your content, niche, consistency, and the market. Any examples or general statements about growth are illustrative and are not a promise of what you will earn. You should be cautious of anyone who guarantees specific earnings.

5. Your responsibilities

If you apply or work with us, you agree that:

• You own your accounts and content, and you have the right to let us help manage them
• You are at least 18 and all individuals appearing in your content are at least 18
• The information you give us is accurate and kept up to date
• Your content and conduct comply with all applicable laws and with the terms of OnlyFans, Fansly, and any other platform you use
• You will cooperate reasonably with our team so we can provide our services

6. Fees and commission

Our services are commission-only unless your management agreement says otherwise. There are no setup fees and no monthly retainer. Your earnings are paid to you first by the platform, and you pay our agreed commission separately — we are never listed as a payee and do not hold your money. The exact commission and payment details are set in your management agreement.

7. Confidentiality and discretion

We keep your identity and the fact that you work with us confidential. In turn, you agree to keep confidential any non-public information we share with you, including our strategies, processes, and pricing. These obligations continue after our working relationship ends.

8. Intellectual property

You keep all ownership of your accounts, content, and brand. The Site itself — including its text, design, graphics, and logos — is owned by Poshy Peach and protected by intellectual property laws. You may not copy, reproduce, or reuse the Site’s content without our written permission.

9. Third-party platforms and links

Our services involve third-party platforms such as OnlyFans, Fansly, and social media networks, and the Site may link to third-party websites. We do not own or control those platforms and are not responsible for their content, policies, availability, or actions, including changes they make or decisions they take about your account. Your use of those platforms is governed by their own terms.

10. Disclaimers

The Site and our services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the fullest extent permitted by law, Poshy Peach and its owners, members, and team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or revenue, arising out of or related to the Site or our services. Our total liability for any claim relating to our services will not exceed the amount of commission you paid us in the three months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Poshy Peach and its owners, members, and team from any claims, losses, or expenses (including reasonable legal fees) arising out of your content, your use of third-party platforms, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Termination

You may stop using the Site at any time. Any working relationship is month-to-month and may be ended by either party as described in your management agreement — there are no lock-in contracts and no cancellation fees. We may also suspend or end access to the Site or our services if you violate these Terms or applicable law. Sections that by their nature should survive termination — such as confidentiality, intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or our services will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect means you accept the updated Terms.
